IMPORTANT INFORMATION
PLEASE READ
TERMS AND CONDITIONS, INCLUDING LIMITED WARRANTY
1. These Terms and Conditions are effective 12/28/2015 and supersede all prior oral or written terms and conditions.
2. Subject to these Terms and Conditions, RK Autowerks, LLC (“RK”) warranties all products manufactured and sold by RK (“RK Products”) against defects in materials or workmanship for a period of two years from the date of purchase (the “RK Limited Warranty”) unless otherwise noted below.
3. OTHER THAN THE RK LIMITED WARRANTY, RK PROVIDES NO WARRANTIES WITH RESPECT TO RK PRODUCTS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW HEREBY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OTHER THAN THE RK LIMITED WARRANTY.
4. RK specifically makes no representation or warranty that (i) any RK Products are legal for use on public roads, (ii) vehicles on which RK Products are installed will pass emissions testing, or (iii) installation of RK products will not void any manufacturer’s warranty.
5. The RK Limited Warranty applies only to the original purchaser of RK Products and is not transferrable.
6. The RK Limited Warranty does not cover any of the following:
- Any loss, damage or expense caused by failure of a non-RK Product
- Any loss, damage or expense caused by improper or poor installation
- Any loss, damage or expense caused by misuse or abuse
- Any loss, damage or expense caused by Acts of God
- Any loss, damage or expense caused by track usage
- Any loss, damage or expense caused by failure to provide adequate maintenance
- Any consequential, incidental or other special damages
- Normal wear and tear
- Costs of packaging or shipping
7. The 30 day 100% satisfaction guaranteed on intake systems is only applicable 30 days from purchase. To qualify one of the following must be present; the intakes do not produce more power than stock configuration, major defect upon arrival, or causes a CEL due to improper MAF reading. Any exceptions to this rule are out of good will and at the sole discretion of RK Autowerks. Returns out of good will are subject to a 30% restocking fee and PayPal processing fees are not refunded. Return shipping is the responsibility of the buyer. If the item included free shipping, the buyer must pay for the original shipping costs. Any core items beyond 30 days are the customers responsibility to coordinate extensions. Otherwise the item is forfeited and no core refund will be refunded. Returned products that have been used are subject to a 50% restocking fee and can be denied completely depending on the product.
8. The RK Limited Warranty does not apply to any non-RK Product, including without limitation Vortech superchargers or Evolve Automotive tuning cables or tunes. Warranties for non- RK Products sold, but not manufactured, by RK are provided exclusively by the manufacturers of such products.
9. To make a claim under the RK Limited Warranty, the original purchaser must notify RK of the nature of the alleged defect in materials or workmanship via e-mail sent to support@rkautowerks.com within thirty (30) days after discovery.
10. The sole remedy for breach of the RK Limited Warranty shall be repair or replacement of the defective RK Product, at RK’s sole discretion.
11. All products must be installed by a professional with proof of installation for warranty to be honored
12. RK Autowerks is not responsible for return shipping.
13. All tunes come with a 30 day window for a retune, outside of the window a service fee will be incurred to retune the vehicle.
14. Filters do not fall under the RK warranty as they are a wear item in the intake systems.
15. Stock Rebuild long blocks carry a 2 year/24,000 mi (whichever comes first) Limited Warranty on the internal parts. If the car has any tune other than the stock tune from BMW after the RK long block has been installed, the warranty is void. In order to receive consultation from RK, a full diagnosis of the issue by a professional BMW shop or dealer must be completed before contacting RK. RK will need to verify the car has not been tuned, as well. Prior to any repair work, FASTA data, ECU read out, compression data, leakdown data; must all be present. If the diagnosis of the issue is at fault of the engine internals, RK will arrange for the appropriate repairs and/or replacement of the damaged long block.
16. High performance forged long blocks do not include any form of warranty. Any claims and/or assistance from RK are out of good will.
17. Under no conditions does the RK Limited Warranty cover installation expenses, vehicle rental expenses, or loss of income.
18. Shipping Policy – RK Autowerks is not responsible for any shipping deliveries that may be affected by shipping delays once in possession of the shipping company, customs, natural occurrences, air and ground transportation strikes or delays, nor any extra fees, customs or backend charges.
19. RK Autowerks has a 2-day handling policy for all orders. Anything more will be communicated directly on website or product page, or via email when order is placed/being placed.
20. RK Autowerks is now utilizing Affirm for our consumers, if you are a dealer with a discount built-in or a coupon code and utilize the Affirm option- you will be charged the percentage based on the order amount that Affirm charges in a separate invoice. This is purely a measure for our consumers, not our wholesale/dealer accounts. Thank you.
21. Engine Deposits are:
- Non-Refundable
- Deposits are used to have your parts ready on shelf for your build. If for some reason you have to cancel, you can use that money as a credit toward a build in the future.
22. RK Autowerks offers Customer Support to our Consumers and Dealers Mon-Fri 9:00am-5:30pm. If you purchase items from a Dealer of ours, please reach out to them for support and they can contact us directly regarding your invoice and items. There will be no exceptions.
23. B-Grade items listed by RK Autowerks under no circumstances will be included in our return or warranty policy. They have been tested for functionality and may have the imperfections stated in the description. Please be sure to read and ask any questions before purchasing.
